Default What Is A Paralegal And Legal Secretary?

There are so many different careers within the legal field and with terminology always changing so it is very difficult to distinguish sometimes between the different terms and jobs that each term entails. Positions like paralegal, legal secretary and legal assistant are a little confusing for me as to what each role consists of and what the differences are between them. Can somebody shed some light on this, what is a paralegal, legal secretary or legal assistant or is it just one profession called different sometimes.

Paralegals can perform many of the same things as lawyers, but they can not practice law, such as giving legal advice. They assist lawyers by dong the "grunt work" for a matter, such as filings, research, tracking status of matters, and document production like in the case of a will or house conveyancing. To become a paralegal, you are required to complete a program in paralegal studies and pass the relevant exams. In the UK, ILEX is the governing body for paralegals. Legal secretaries, on the other hand, (or legal assistants/legal administrative assistants) perform clerical/administrative tasks, such as arranging conference calls, travel coordination, composing/transcribing letters, creating presentations and worksheets, purchase supplies and general office duties. The legal administrative assistant may also handle billing, payroll, human resource or other issues, depending on the size and type of company. Although no degree or certification is needed, proficiency in computer software applications, such as word processing, database management, spreadsheet and presentation creation is required.

With experience and training, many legal secretaries and administrative assistants become paralegals.

A legal secretary, up until recently was the role which most non-attorneys held in a law office. Legal secretaries were most often female and they weren’t really much different than a normal secretary. A legal secretary however did have specialized training so that they could become more knowledgeable about matters relating to the legal field. Specialized training in the legal field is required for the legal secretary to be more efficient and effective at the job. Some legal secretaries had college degrees but usually it was up to each individual employer whether they required a college degree or not.

When legal assistants become a more common role in law offices it was a much different role than a legal secretary and required different and more qualifications. A legal assistant has a much more active role in the law office and as such they need to be more familiar with all aspects of the law. A legal assistant is someone that assists an attorney but it is a job that is very hands on and needs a qualified and dedicated person for the job.

Nowadays the role of assistant to attorney is often referred to as either legal assistant or paralegal. Many people in this role prefer to be called a paralegal but in actual fact the two positions are the same. While a legal secretary is more of a clerical role, the role of a paralegal or legal assistant is much different.

A paralegal, as InterestingJobs already said, will have many legal duties even though these duties are assigned by an attorney and carried out under the direction of an attorney. A paralegal lightens the attorney’s workload by taking on the tasks and responsibilities that they are qualified for. A paralegal’s duties may include interviewing witnesses for a court case, performing research and compiling statistics and other duties that are vital to the ongoing work of an attorney.
The role of a paralegal is filled by both men and women, although there are more women paralegal’s it is a role that many men are now finding rewarding both personally and professionally. While the role of legal secretary has mostly been dominated by women, the role of a paralegal certainly has more men enjoying a career in this role.

To summarize, a paralegal is someone that works in a law office that assists an attorney. The role of a paralegal requires some education qualifications but is one that can give a very rewarding and interesting career.

Legal secretary and paralegal are one of the same. It is a pretty stressful job because you are dealing with a lot of Type A personalities (aka lawyers).
